These Terms and Conditions (“Terms”) govern your use of tokarsi.com and purchases from Swastik & Co., trading as TOKARSI (“TOKARSI,” “we,” “us,” “our”). By accessing the site or purchasing from us, you agree to these Terms and the policies referenced here.

Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell our products and services.

Online Store Terms

You confirm you are the age of majority in your jurisdiction (or have consent from a parent/guardian). You agree not to use the site for unlawful purposes, infringe IP, submit malicious code, or violate any applicable laws.

General Conditions

We may refuse service to anyone, at any time, for reasonable grounds (e.g., fraud prevention, unsafe address, policy abuse). Except for payment information, content you submit may be transmitted unencrypted over networks. Card data is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our written permission.

Product Information, Craft & Hallmarking

We primarily offer sterling-silver jewelry; where applicable, items are BIS-hallmarked and product pages specify metal, plating (e.g., rhodium/gold-vermeil), dimensions and weight. Minor variations may occur due to handcrafted processes and screen/lighting differences.

Prices, Taxes & Changes

Prices are in INR and may change without notice. Taxes and any shipping/COD fees are shown at checkout. We may modify or discontinue products or features at any time.

Orders, Billing & Account Information

We may limit or cancel quantities per person/household/order. If we change or cancel an order, we’ll attempt to notify you using the contact details provided. You agree to provide current, complete and accurate purchase and account information. See our Return & Refund Policy for more on order adjustments.

Shipping & Delivery (summary)

Dispatch timelines and carriers are described on our Shipping Policy page. Risk passes on delivery to the address you provide. Please retain outer packaging for 24 hours after delivery in case a claim is needed.

Returns & Exchanges (summary)

Our full Refunds & Returns Policy applies; this is a summary for convenience:

  • Eligibility & window. You may request a return within 15 days from the courier-recorded delivery date for purchases made on tokarsi.com. Items must be unused, unworn, undamaged, and returned with all inclusions (box, pouch, tags/labels, certificates and any free gifts). Order ID required.

  • Empty/tampered/missing claims. Contact us within 24 hours and provide a single, uncut 360° unboxing video (showing the shipping label, intact/tampered seal, full opening and contents). Failure to provide the required evidence may result in claim rejection.

  • Non-returnables (high level). Pierced jewellery after the hygiene seal/tag is opened; custom/engraved/personalised/resized/made-to-order items; international orders; discounted/sale/coupon purchases; gift cards/store credit and service fees (replating/repairs/engraving); items marked Final Sale; items not in original condition or missing inclusions.

  • Who pays shipping. For change-of-mind returns, the customer pays one-way return shipping. If we arrange a reverse pickup, the actual courier cost is deducted from the refund; if you self-ship, you pay your carrier. For defect/damage/wrong item, we cover return shipping (self-ship reimbursement up to ₹120 with receipt when reverse pickup is unavailable).

  • Process. Initiate via WhatsApp [number] or support@tokarsi.com. We aim to approve within 24 business hours. Hand over within 3 calendar days of approval (up to 2 pickup attempts). QC is completed within 24–48 business hours after warehouse receipt. If inclusions are missing/wear is detected, the return may be rejected and shipped back. If a free promotional item is not returned, we deduct its MRP.

  • Exchange & replacement. Replacements or exchanges are available under the same conditions as returns. Once the original item is received and passes QC, we ship the replacement. Subject to stock availability; if unavailable, you may choose a refund to original payment method or store credit (valid 12 months).
Refund Method & Duration

On approved returns, we refund to your original payment method (COD orders: bank/UPI). We initiate within 2–3 business days of QC pass, and refunds typically reflect within 7–10 business days from QC pass, depending on your payment provider:

UPI/Netbanking: 1–3 business days • Cards: 5–7 business days • Wallets: 1–3 business days • COD to bank/UPI: 2–5 business days after details are verified.

For change-of-mind returns with reverse pickup, the one-way courier charge is deducted before initiation. “Business days” exclude weekends and bank/public holidays; actual posting times may vary by bank/payment gateway.

International Orders

COD is not available for international shipments. Returns/exchanges are not applicable on international orders, except where required by law for items received damaged or incorrect (contact us within 24 hours with evidence). Import duties/taxes/brokerage are payable by the recipient. Undeliverable/refused parcels may be returned to sender; we may deduct two-way international shipping and any customs charges from any eligible refund.

Order Cancellations & Verification

We may cancel an order (with a full refund) if we detect stock errors, payment/KYC issues, invalid or unsafe addresses, suspected fraud, or repeated delivery failures. We may verify order details (address, contact, quantity, high-value orders) by email/WhatsApp/phone before dispatch; if we cannot reach you or verify within a reasonable time, the order may be cancelled and refunded.

Customer cancellations: you may cancel before dispatch by contacting support; after dispatch, please use the Returns process.

Promotions, Bundles & Free Gifts

If your order included a promotional/free item, it must be returned with the principal product for a refund/exchange. If not returned, we will deduct the free item’s MRP.

Gift Cards & Store Credit

TOKARSI e-gift cards/store credit are non-refundable and valid for at least 12 months from issue, unless longer validity is stated. Redemption and refunds are processed per RBI norms. Store credit is usable only on tokarsi.com.

Optional Tools & Third-Party Links

We may provide access to third-party tools or link to third-party sites. Those are provided “as is” and “as available” without warranties. Use is at your own risk and governed by the third party’s terms.

User Content (Reviews, Feedback, Submissions)

If you send reviews, photos, suggestions or other content, you grant us a non-exclusive licence to use, edit, copy, publish and distribute them in connection with our services and marketing (with credit where feasible). You are responsible for your submissions and must not post unlawful, defamatory, obscene, or infringing content.

Prohibited Uses

You must not use the site or its content for unlawful activity, to solicit unlawful acts, violate regulations, infringe IP, harass or harm others, submit false/misleading information, upload malware, collect others’ personal information, or interfere with the security features of the Service.

Warranty & Repairs (summary)

If a product is received defective, damaged or incorrect, we will replace or refund once validated per our Returns process. Beyond statutory rights, additional warranties (if any) will be disclosed on the product page or our Warranty page. Re-plating/repair services (if offered) are chargeable; service fees are non-refundable.

Disclaimer; Limitation of Liability

We do not guarantee the Service will be uninterrupted, timely, secure or error-free. To the maximum extent permitted by law (and without limiting your statutory consumer rights), the site and products are provided “as is” and “as available.” TOKARSI and its affiliates will not be liable for indirect, incidental or consequential damages; our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.

Indemnity

You agree to indemnify and hold harmless TOKARSI, its affiliates, officers, employees and service providers from claims and expenses (including reasonable legal fees) arising from your breach of these Terms or violation of law or third-party rights.

Sever-ability

If any provision of these Terms is unlawful, void or unenforceable, that provision will be deemed severed without affecting the validity of the remaining provisions.

Termination

We may terminate or suspend access to the Service at any time if you breach these Terms. Obligations incurred prior to termination survive. You may stop using the site at any time.

Changes to These Term

You can review the most current version of these Terms at any time on this page. We may update them by posting changes on the site; your continued use after posting constitutes acceptance.

Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts at Ahmedabad, Gujarat have exclusive jurisdiction.

Communications Consent

By providing your mobile number or email, you consent to receive transactional emails/WhatsApp/SMS related to orders and support.

Grievance Redressal (India)

We appoint a Grievance Officer to address consumer complaints related to the site and services.
